Information on the transfer of data to the USA or other third countries

We use, among other things, tools of companies with their registered office in the USA or other third countries which are not secure under data protection laws. If those tools are active, your personal data may be transferred to those third countries and processed there. Please note that in those countries a level of data protection comparable with the level prevailing in the EU cannot be guaranteed. For example, US companies are obliged to surrender personal data to security authorities and you as a data subject have no possibility of taking action to oppose this through the courts. It cannot therefore be ruled out that US authorities (e.g. intelligence services) will process, analyse and permanently store data concerning you which is stored on US servers for the purpose of surveillance. We have no influence on those processing activities.

Revocation of your consent to data processing

Many data processing processes are only possible with your explicit consent. You may withdraw consent that you have already granted at any time. The legality of the data processing that has occurred up to the date of the revocation remains unaffected by it.

Right of objection to data collection in special cases and to direct marketing (Article 21 GDPR)

IF THE DATA PROCESSING OCCURS ON THE BASIS OF ARTICLE 6(1) POINT E) OR F) GDPR, YOU HAVE THE RIGHT TO LODGE AN OBJECTION TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME, FOR REASONS THAT ARISE FROM YOUR PARTICULAR CIRCUMSTANCES. THIS ALSO APPLIES TO PROFILING BASED ON THOSE PROVISIONS. YOU CAN FIND INFORMATION ON THE RESPECTIVE LEGAL BASIS FOR PROCESSING IN THIS PRIVACY POLICY. IF YOU LODGE AN OBJECTION WE WILL NO LONGER PROCESS THE RELEVANT DATA CONCERNING YOU UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE REASONS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS OR THE PROCESSING SERVES THE PURPOSE OF THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION IN ACCORDANCE WITH ARTICLE 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF CONDUCTING DIRECT MARKETING, YOU HAVE THE RIGHT TO LODGE AN OBJECTION AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. THIS ALSO APPLIES TO PROFILING, INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL THEN NO LONGER BE USED FOR THE PURPOSES OF DIRECT MARKETING (OBJECTION IN ACCORDANCE WITH ARTICLE 21(1) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of breaches of the GDPR, data subjects are entitled to a right to lodge a complaint with a supervisory authority, particularly in the Member State where their habitual residence, place of work or the place where the alleged breach occurred are located. The right to lodge a complaint exists without prejudice to other legal remedies under administrative law or judicial remedies.

Right to data portability

You have the right to have data that we automatically process on the basis of your consent or in fulfilment of a contract delivered to you or a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only occur insofar as it is technically feasible.

Information, erasure and rectification

You have the right, within the framework of the applicable provisions of law, to obtain at any time and free of charge information on your stored personal data, its origin and recipients and the purpose of the data processing, and where applicable a right to rectification or erasure of that data. You may contact at any time us for that purpose or with regard to other issues relating to personal data.

Right to restriction of the processing

You have the right to demand the restriction of the processing of your personal data. For that purpose you may contact us at any time. The right to restriction of the processing exists in the following cases:

  • If you dispute the correctness of data concerning you which we are storing, we will generally need time to verify this. For the duration of such a verification, you have the right to demand the restriction of the processing of your personal data.
    •    If the processing of your personal data has occurred/occurs unlawfully, instead of erasure you may demand the restriction of the data processing.
    •    If we no longer need your personal data, but you need it for the exercise, defence or establishment of legal claims, instead of erasure you may demand the restriction of the processing of your personal data.
    •    If you have lodged an objection in accordance with Article 21(1) GDPR, your and our interests must be weighed against each other. Until it has been clarified whose interests are overriding, you have the right to demand the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, with the exception of storage thereof, that data may only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL / TLS encryption

For security reasons and for the protection of the transfer of confidential content, for example orders or enquiries that you send us as the site operator, this site uses SSL / TLS encryption. You can identify an encrypted connection due to the fact that the address line of the browser changes from “http://” to “https://” and by the padlock symbol in your browser line.

If SSL / TLS encryption is activated, the data that you transmit to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our website uses so-called “cookies”. Cookies are small text files and they do not cause any damage to your end device. They are stored on your end device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically erased after the end of your visit. Permanent cookies remain stored on your end device until you erase them yourself or erasure is carried out automatically by your browser.

In some cases, cookies of third-party companies may also be stored on your end device if you enter our site (third-party cookies). They enable us or you to use certain services of the third-party company (e.g. cookies for handling payment services).
Cookies have various functions. Many cookies are technically necessary as certain website functions would not work without them (e.g. the shopping cart function or video display). Other cookies serve the purpose of analysing user behaviour or displaying advertising.

Cookies which are necessary (necessary cookies) for the purpose of implementing the electronic communication process, for the provision of certain functions desired by you (e.g. for the shopping cart function) or for the optimisation of the website (e.g. cookies for measuring the online audience) are stored on the basis of Article 6(1) point f) GDPR, unless a different legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically flawless and optimised provision of its services. Insofar as consent has been requested for the storage of cookies or similar recognition technologies, the processing occurs exclusively on the basis of that consent (Article 6(1) point a) GDPR and Article 25 par. 1 TTDSG). That consent may be revoked at any time.

You may set your browser such that you are informed about the installation of cookies and only permit cookies in an individual case, exclude the acceptance of cookies in certain cases or generally exclude them or activate automatic erasure of the cookies when you close the browser. If you deactivate cookies, the functionality of this website may be restricted.

Insofar as cookies are used by third-party companies or for the purposes of analysis, we shall separately inform you to that effect in this privacy policy and, where applicable, request consent.

Consent with Usercentrics

This website uses the consent technology of Usercentrics in order to obtain your consent to the storage of certain cookies on your end device or to the use of certain technologies and to document such consent in line with data protection requirements. The provider of that technology is Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, website: https://usercentrics.com/de/ (hereinafter “Usercentrics”).

If you enter our website, the following personal data is transferred to Usercentrics:

  • Your consent(s) / the revocation of your consent(s)
  • Your IP address
  • Information about your browser
  • Information about your end device
  • The time of your visit to the website

Usercentrics also stores a cookie in your browser to enable it to attribute the granted consents / revocation thereof to you. The thus recorded data is stored until you request that we erase it, you erase the Usercentrics cookie yourself or the purpose of the data storage no longer pertains. Mandatory statutory retention requirements remain unaffected.

We use Usercentrics in order to obtain the legally required consents to the use of certain technologies. The legal basis for this is Article 6(1) point c) GDPR.

Contract processing

We have concluded a contract on contract processing (CPC) with the above-mentioned provider. It is a contract prescribed by data protection laws that ensures that the provider only processes personal data of our website visitors according to our instructions and in compliance with the GDPR.

Server log files

The provider of this site automatically collects and stores information in so-called server log files which your browser automatically transmits to us. That information consists of:

  • browser type and browser version
  • the operating system in use
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • IP address

That data is not combined with other data sources.

That data is recorded on the basis of Article 6(1) point f) GDPR. The website operator has a legitimate interest in the technically flawless presentation and optimisation of its website – the server log files must be recorded for that purpose.

Enquiries by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your enquiry including all associated personal data (name, enquiry) will be stored and processed by us for the purposes of processing your matter. We will not pass that data on without your consent.

That data is processed on the basis of Article 6(1) point b) GDPR, insofar as your enquiry is related to the fulfilment of a contract or is necessary for the purpose of implementing pre-contractual measures. In all other cases the processing is based on our legitimate interest in the effective processing of enquiries submitted to us (Article 6(1) point f) GDPR) or on your consent (Article 6(1) point a) GDPR) insofar as it has been requested. The consent may be revoked at any time.

The data that you send us via contact enquiries remains with us until you request that we erase it or withdraw your consent to its storage, or the purpose for the data storage no longer pertains (e.g. after the processing of your matter has been completed). Mandatory provisions of law – particularly statutory retention periods – remain unaffected.

5.  Analysis tools and advertising

Matomo

This website uses the open source web analysis service Matomo. Matomo uses technologies that enable cross-website recognition of the user for the analysis of user behaviour (e.g. cookies or device fingerprinting). The information recorded by Matomo on the use of this website is stored on our server. The IP address is anonymised before storage.

With the aid of Matomo we are able to record and analyse data on the use of our website by website visitors. As a result we can, among other things, find out when page views occurred and which ones and the region from which they originate. We also record various log files (e.g. IP address, referrer, the browser and operating systems used) and can determine whether our website visitors perform particular actions (e.g. clicks, purchases etc.).

This analysis tool is used on the basis of Article 6(1) point f) GDPR. The website operator has a legitimate interest in the analysis of user behaviour in order to optimise both its online service and its advertising. If appropriate consent has been requested, the processing occurs exclusively on the basis of Article 6(1) point a) GDPR and Article 25 par. 1 of the German Telecommunications and Telemedia Privacy Protection Act (TTDSG), insofar as the consent covers the storage of cookies or access to information in the user’s end device (e.g. device fingerprinting) in the meaning of TTDSG. The consent may be revoked at any time.

IP anonymisation

In the course of the analysis using Matomo we employ IP anonymisation, in which your IP address is abbreviated before the analysis so that it can no longer be unequivocally ascribed to you.

6. Plug-ins and tools

The use of Vimeo occurs in the interests of ensuring an appealing presentation of our online service. This constitutes a legitimate interest in the meaning of Article 6(1) point f) GDPR. Insofar as appropriate consent has been requested, the processing occurs exclusively on the basis of Article 6(1) point a) GDPR. The consent may be revoked at any time.

The data transmission to the USA is based on standard contractual clauses of the EU Commission as well as (according to Vimeo’s statement) on “justified business interests”. You can find details here: https://vimeo.com/privacy.
